CENTRAL DE RESERVAS DESIG, S.L (from now on referred as the booking central) supplies up to date and useful information about houses, hotels and properties of touristic use (referred as ACCOMMODATIONS) and provides the way to realize online bookings for the mentioned accommodations.

It is very important to read and understand these terms and conditions before using our services. Using our services means the client is legally bound to the present conditions and to the possible changes that may affect the client in the future. Please mind that some apartments have special conditions regarding payment methods, minimum age requirements, check in/out hours, behavior rules, etc. These special conditions can be found at each of the apartment's profile under the title "Particular Conditions". The special conditions of each apartment will prevail, in all cases, over the following general conditions. Be sure to read these conditions before completing a booking.

Our organization acts as an intermediary between the users of our website and the ACCOMMODATIONS. By using our services and making a booking, the contractual relation is established between the users/clients and the owner of the ACCOMMODATION.

The BOOKING CENTRAL is only responsible for the website operational. The website content is provided and updated by the ACCOMMODATIONS owners and is available to users for free.

As far as the ACCOMMODATION owner is concerned, he is the one responsible for all possible claims that he might receive from the client with respect to the ACCOMMODATION, the operation and quality of his services, installations (facilities), etc, so that the clients, in any case, should address their claims to the owners directly. The BOOKING CENTRAL offers the clients a quality control of the services provided via online reviews and questionnaires. Once the user / client has checked out of the accommodation, the client will be asked to fill in a review in order to obtain information about the quality, accuracy ande veracity of the data strengthened by the owners of the ACCOMMODATIONS.

Using the services contained in the present BOOKING CENTRAL website implies that the user has accepted the following general conditions:

  1. The user declares that is legally of age (older than 18 years old) and has the legal and the necessary capacity to contract the services offered as ACCOMMODATIONS
  2. In order to make a booking you have to follow the steps marked in the conditions.
  3. All the bookings accepted from our website are subjected to each of the owners particular conditions in each one of the ACCOMMODATIONS.

The present terms and conditions have been translated to several languages, however, in case of misunderstanding, the Spanish version will be the one imposed.

PAYMENT AND BOOKING CONFIRMATION

While completing the booking process, the user has to indicate the exact number of persons that will be lodged in the apartment. Children above 4 years old are considered "Adults" and must be included in the number of adults selected. The "Children" option is available only for children under 4 years old that can sleep in a cot (where available) or in their parents' bed. Please mind that requesting a baby cot might have an additional cost.

The booking center offers free lodging for ONLY one child under 4 years old. In case you are travelling with more than one child under 4 years old. Please mind that only one child will be admitted for free and the rest of them will be considered adults and will have to pay the full rate.

Once the users has checked the availability of the ACCOMMODATION and in order to be able to make the booking, we will charge your credit card with the corresponding booking percentage of the selected ACCOMMODATION total cost, which would have been clearly specified within the booking process in euros (€).

After paying the booking down payment, the user (now client) will receive a confirmation email with all the booking details. If the client does not receive it, he will need to contact info@apartmentbarcelona.com so the BOOKING CENTRAL can send the booking details once again to the e-mail address provided through the booking process. This e-mail will include the details of a contact person, that can be either the owner of the ACCOMMODATION or his representative, whom is not related to the BOOKING CENTRAL.

Please remember that upon arrival at the ACCOMMODATION the outstanding amount stated in the booking confirmation will need to be paid in cash and in euros (€) to the contact person.

INVOICING CONDITIONS

The invoicing amount of the online booking will be send out by the CENTRAL DE RESERVAS. The invoice will be send by mail after the booking transaction.The LANDLORD will send the guest the invoicing of the rest of the amount, which corresponds to the payment of the housing. The guest will need to ask the person he/she will be in contact with as he/she does the check-in to give him/her this invoicing.

Due to the booking cancellation terms and conditions, invoices will not be issued with more than 7 days before the arrival date.

TOURIST TAX:

From the 1st of November 2012, the Catalan Government will apply a tourist tax to all the tourists who will spend a night in any housing in Catalonia.

The amount of the fees will always be applied according to current regulations. As a guideline, the tourist tax to pay shall have the following conditions:

  • Accommodation in Barcelona city: the rate will be 0.75 euros per person, per night.
  • Accommodation in the rest of Catalonia, the rate will be 0.50 euros per person, per night.
  • The amount of the fee will be applied to each night of stay, until a maximum of seven (07) nights.
  • Children under 16 are exempt from the tourist rate.
  • Fees must be paid in cash during the check-in at the housing.
Concerning the invoicing, the Central Reservations Desig SL cannot make invoices reflecting the amount paid for tourist rates, given that the pre-payment of the accommodation do not include the tourist tax. The charging and billing of taxes will be in charge of the owner of the accommodation and / or his representative.

CHANGES

Date Changes

It will be possible to change the dates of the booking ONCE when at least 20 days in advance and as long as the ACCOMMODATION is available. If you're willing to ADD nights to your booking and if the availability allows it, a percentage of the extra nights must be paid in order to confirm the change.

If you're willing to REDUCE nights to your booking, you must do it at least 20 days before the arrival date and there will be a penalty of 25% of the total price of the reduced nights. Changes within a period of less than 20 days will not be accepted, and the total price of the booked days will have to be paid. These conditions will not be applicable to bookings longer than 25 days as the monthly rates are subject to special conditions.

Apartment changes

It will not be possible to change ACCOMMODATION when each of them is independent from the others. In case you need to change your ACCOMMODATION, you will need to cancel your confirmed booking, bound to cancellation conditions (stated further) and make a new booking.

Number of persons change

If after booking an ACCOMMODATION the client needs to INCREASE the number of persons, this will only be possible if the maximum number of persons allows this. A new price will be calculated and the client will have to pay a percentage of the price difference to confirm the change.

If the client wants to DECREASE the number of persons, the total price will always remain the same. These conditions are not applicable for bookings longer than 25 days as monthly rates are subject to special conditions.

CANCELLATION

** Some apartments may have special cancellation conditions. These conditions are specified under "Particular Conditions" in each of the apartments' profiles. The special cancellation conditions of each apartment will prevail, in all cases, over the following general conditions of cancellation.**

**General cancellation policies will not be applied to bookings longer than 25 nights (aka Monthly Rentals). Please consult about these special conditions before booking**

** No reimbursement at all will be issued when canceling a reservation where a promotional code has been used. **

Cancellation due to willingness of the customer.

The client has a period of 7 natural days, from the moment they receive the confirmation booking, in order to cancel the booking without need to justify it and with no cost at all, except for thirty Euros (30€) under the concept of administrative fees, plus credit card payment commissions, provided that the deadline for checking in into the apartment is more than 7 working days. This cancellation must be reliably notified to both the BOOKING CENTRAL and the ACCOMMODATION.

After that period (7 natural days), the cancellation will allow the BOOKING CENTRAL to retain as much as the following amounts, plus the according administrative fees and credit card payment commissions:

  1. 50% of the pre-payment plus thirty Euros (30€) under the concept of administrative fees; when the cancellation is informed more than 7 working days in advance to the arrival date at the ACCOMMODATION.
  2. 100% of the pre-payment when the cancellation is informed within less than 7 working days prior to the arrival date at the ACCOMMODATION.

Force Majeure Cancellations (by the Accommodation)

Under unforeseen circumstances or unexpected (exceptional) circumstances that may prevent the client from using the selected ACCOMMODATION, the BOOKING CENTRAL will offer the client an alternative ACCOMMODATION of similar characteristics. In case the client does not agree with the new proposed ACCOMMODATION, the booking may be cancelled and the pre-payment would be completely refunded. In this case, the BOOKING CENTRAL will not be liable for further claims by the client if this cancellation occurs.

Overbooking or booking duplicity cancellations.

In case of overbooking (booking duplicity) due to the ACCOMMODATION´s calendar not being updated by the owners, the ACCOMMODATION will be bound to pay for the damages that the overbooking may cause to both the users and the BOOKING CENTRAL. In this case, the BOOKING CENTRAL will not be liable for further claims by the client.

COMMUNICATION BETWEEN THE CLIENT AND THE ACCOMMODATIONS´ OWNER

Once the client has received the booking confirmation, they will need to contact the accommodations owner or the contact person that he might had appointed, at least 2 working days in advance, whose personal details will be found in the confirmation e-mail; in order to confirm the client´s arrival details. Only when no communication at all has been met when the 2 working days period is reached, the client will have to contact the BOOKING CENTRAL in order to improve the communication between the parts.

CONTRACT AND DELIVERY OF THE KEYS

When the client arrives at his destination it is necessary to call the contact person at least 30 minutes before arriving at the ACCOMMODATION OR THE CHECK IN OFFICE (the telephone number can be found in the confirmation e-mail) to confirm, so the contact person can be present to hand over the keys, the contract and to show how certain devices work. The client will have to pay the outstanding amount of the ACCOMMODATION in cash annd Euros(€).
In case the ACCOMMODATION is a property under tourist use the client will receive a rental contract either through the owner or his representative. The client has the right to receive a copy of the contract. At that moment, the client will need to pay the outstanding rental amount in cash together with the refundable deposit.

STAY AND RETURN OF THE KEYS

In case of emergency, questions or other problems, the client can contact the ACCOMMODATION contact person. Upon departure the ACCOMMODATION contact person will come to the ACCOMMODATION to confirm if the apartment is in the exact same shape as it was on check in and will refund the whole deposit. The client then is obliged to return the keys.

NUMBER OF GUESTS

It is not allowed to exceed the arranged number of persons without prior permission of the BOOKING CENTRAL. In case of agreement the price is subject to change. The number of persons using the ACCOMMODATION may not exceed the number of persons allocated for each ACCOMMODATION.

OTHER RULES AND GENERAL CONDITIONS

The client is obliged to leave the ACCOMMODATION in the same conditions as it was at the day of arrival and has to fulfil the established obligations by the ACCOMMODATION´s owner.

The usere hereby consents to the jurisdiction of the courts and tribunals of Barcelona, Spain, renouncing to their own jurisdiction.

TOURIST TAX

  • · Fees must be paid in cash during the check-in at the accommodation.

Concerning the billing, the Central Reservations Desig SL cannot make invoices reflecting the amount paid for tourist rates, given that the pre-payment of the accommodation do not include the tourist tax. The charging and billing of taxes will be in charge of the owner of the accommodation and / or his representative.

In compliance with article 5, section 1.a) of the Spanish Personal Data Protection Act 15/1999, we inform you that the personal data you transmitted to us will be inserted in a file, which has been notified to the Agency for Data Protection, and will be processed and used in order to fulfill the services you selected. Access to these data is limited to those employees and providers who need to know these data in order to guarantee the before mentioned services.
